TERMS AND CONDITIONS FOR ALL BOOKCOZUMEL DIGITAL PLATFORM USERS

1. Introduction

Welcome to Bookcozumel.com, a digital booking platform connecting travelers with hosts in Cozumel, Mexico. These terms and conditions govern your use of our platform as a traveler or a host. By accessing or using Bookcozumel.com, you agree to comply with and be bound by these terms and conditions.

2. Travelers

2.1 Booking Process

By using Bookcozumel.com, travelers agree to abide by the booking process outlined on the platform.

Travelers must provide accurate and complete information when booking accommodations through our platform.

2.2 Payment

Travelers agree to pay the specified nightly rate, including any applicable taxes, at the time of booking.

Payments are processed securely through our platform’s payment gateway or directly with property owners according to the agreement.

2.3 Cancellation Policy

Travelers must adhere to the cancellation policy specified by the host when canceling a booking.

Any refunds will be subject to the cancellation policy and may be processed through our platform or by property owner.

3. Hosts

3.1 Listing Properties

Hosts must subscribe to a monthly recurring subscription to list their properties on Bookcozumel.com.

Alternatively, hosts can join our company and list their properties for free, with a 20% commission paid off each booking made through our platform.

3.2 Monthly subscription

The monthly subscription fee for listing a property on our platform is subject to change at the discretion of the Company. In the event of a subscription fee adjustment, the Company will provide advance notice to Owners. Notifications will be sent via email and/or through the platform messaging system. Any changes to the subscription fee will take effect in the billing cycle following the notification period, allowing Owners ample time to make any necessary adjustments.

3.3 Property Information

Hosts listing their properties on Bookcozumel.com must provide accurate and up-to-date information about their accommodations.

Hosts are responsible for ensuring that their listings comply with all applicable laws and regulations.

4. Disclaimer of Liability

4.1 Platform Use: The Company provides a digital platform to facilitate the booking and management of vacation rental properties. The Company itself is not a party to any rental agreement between the Owner and the Guest.

4.2 Third-Party Transactions: The Company is not responsible for any transactions, agreements, or disputes that arise between the Owner and the Guest. All financial and contractual matters are solely between the Owner and the Guest.

4.3 Quality of Service: The Company does not guarantee the quality, safety, legality, or suitability of any property or the accuracy of any listing. The Company is not responsible for the conduct of any Owner or Guest.

4.4 Liability: The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform, the rental properties, or any interactions between Owners and Guests. Owners and Guests agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from their use of the platform or rental agreements.

4.5 Service Limitation: The Company is only responsible for services provided directly by BookCozumel Property Management at properties we manage. This includes but is not limited to booking management, guest communication, cleaning, maintenance, and financial reporting. The Company is not responsible for any services provided by third parties that are not directly managed or overseen by BookCozumel Property Management. This includes any external activities, excursions, or additional services arranged independently by Guests or Owners.

5. Property Verification

5.1 Verification Process: To ensure the authenticity and quality of the properties listed on our platform, every property will be verified by our team either via video call or through an in-person visit.

5.2 Owner Cooperation: Owners must cooperate with the verification process by providing access to the property and participating in a scheduled video call or in-person inspection.

5.3 Scam Prevention: This verification process is designed to prevent fraudulent listings and protect both Owners and Guests from potential scams. Properties that fail to pass the verification process will not be listed on our platform.

5.4 Continuous Monitoring: The Company reserves the right to re-verify properties periodically to ensure continued compliance with our standards and to maintain the integrity of our platform.

6. Subscription and Listing Management

6.1 Subscription Charges: The Company operates on a subscription-based model. Owners are required to maintain an active subscription to keep their properties listed on our platform.

6.2 Failed Charges: If the platform fails to process the subscription payment for any reason, the Owner will be notified immediately.

6.3 Listing Pause: In the event of a failed subscription charge, the property listing will be paused for a period of 30 days, during which the Owner can update their payment information and resolve the issue.

6.4 Listing Removal: If the subscription payment issue is not resolved within the 30-day pause period, the property listing will be permanently erased from the platform. Owners will need to re-subscribe and undergo the verification process again to relist their property.

7. Personal Bank Information

14.1 Data Privacy: The Company values the privacy and security of its users. Our digital platform, BookCozumel.com, does not store, share, collect, or have access to the personal bank information of any user.

7.2 Payment Processing: All payment transactions are processed through secure third-party payment processors. These processors are responsible for handling and safeguarding your payment information.

7.3 User Responsibility: Users are encouraged to review the privacy policies of our third-party payment processors to understand how their personal bank information is managed.

7.4 Data Protection: While we strive to protect your personal information, we are not responsible for any breaches or unauthorized access to your personal bank information managed by third-party payment processors.

8. Negative Reviews and Guest Complaints

8.1 Right to Pause or Delete Listings: The Company reserves the right to pause or delete a property listing in the event of receiving a negative review or a guest complaint. This action may be taken to ensure the quality and reliability of the properties listed on our platform.

8.2 Review Process: Upon receiving a negative review or complaint, the Company will review the issue and may request additional information from the Owner and/or Guest. Based on the findings, appropriate action will be taken, which may include pausing or deleting the listing.

8.3 Owner Notification: Owners will be notified of any decision to pause or delete their listing and will be given an opportunity to address the complaint or review before final action is taken.

9. Dispute Resolution between Guests and Hosts

9.1 Third-Party Disagreements: The Company’s platform is not responsible for solving disagreements or disputes between Guests and Hosts. While we strive to provide a seamless experience, any issues that arise from the rental agreement are the sole responsibility of the involved parties.

9.2 Mediation Role: The Company may, at its discretion, offer mediation support to facilitate a resolution between Guests and Hosts. However, this does not constitute an obligation or liability on the part of the Company to resolve such disputes.

9.3 Indemnification: Guests and Hosts agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from disputes or disagreements between them.

10. General Provisions

10.1 Privacy

We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for details on how we collect, use, and disclose your information.

10.2 Intellectual Property

All content and materials on Bookcozumel.com, including text, images, and logos, are the property of Bookcozumel.com and are protected by copyright and other intellectual property laws.

10.3 Amendments

We reserve the right to amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on Bookcozumel.com.

10.4 Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Mexico. Any disputes arising out of or relating to these terms and conditions shall be resolved exclusively by the courts of Mexico.

TERMS AND CONDITIONS FOR BOOKCOZUMEL PROPERTY MANAGEMENT CLIENTS

1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between Bookcozumel Property Management (“Company,” “we,” “us,” or “our”) and property owners (“Owner”) and guests (“Guest”) regarding the management and rental of vacation properties. By engaging our services or booking a property, you agree to these Terms.

2. Services Provided

2.1 Property Management: The Company provides comprehensive property management services, including marketing, booking management, guest communication, cleaning, maintenance, and financial reporting.

2.2 Guest Services: The Company facilitates the rental process, providing guests with property details, booking confirmations, check-in/out instructions, and customer support during their stay.


3. Owner Responsibilities

3.1 Exclusive Management: Owners confirm that their property will be exclusively managed by the Company and will not be listed with any other management service or available for sale during the term of the agreement.

3.2 Property Standards: Owners must maintain their property in a safe, clean, and habitable condition. All appliances and amenities must be functional and comply with local regulations.

3.3 Legal Compliance: Owners are responsible for ensuring their property complies with all applicable laws, including zoning laws, health and safety regulations, and taxation requirements.

3.4 Insurance: Owners must maintain adequate insurance coverage for their property, including liability insurance.

4. Booking and Payments

4.1 Booking Process: Guests can book properties through our website, directly with owners or approved third-party platforms. All bookings are subject to availability and confirmation.

4.2 Payment Terms: Guests must provide valid payment information at the time of booking. Full payment is required to secure a reservation unless otherwise specified.

4.3 Fees and Charges: Owners agree to pay the Company subscription cost or a management fee as outlined in the management contract. Guests are responsible for the rental fee, cleaning fee, and any additional charges specified at the time of booking.

4.4 Cancellations and Refunds:

Owner Cancellations: Owners must honor all confirmed bookings. Cancellations by Owners may result in penalties as outlined in the management agreement.

Guest Cancellations: Cancellation policies for guests are specified at the time of booking. Refunds, if applicable, are processed according to these policies.

5. Guest Responsibilities

5.1 Property Use: Guests must use the property responsibly and comply with all house rules provided by the Owner or Company. Guests are responsible for any damages caused during their stay.

5.2 Occupancy Limits: Guests must adhere to the occupancy limits specified in the booking confirmation. Exceeding these limits may result in additional charges or termination of the rental agreement.

5.3 Conduct: Guests must conduct themselves in a manner that does not disturb neighbors or violate local laws. The Company and Owners reserve the right to terminate the rental agreement for disruptive behavior.

6. Intellectual Property

6.1 Marketing Materials: The Company will create photo and video materials to promote the property. These materials are the intellectual property of the Company and can be used for marketing purposes.

6.2 Post-Contract Use: Upon termination of the management agreement, the Company reserves the right to erase all promotional materials from all digital sources.

7. Liability and Dispute Resolution

7.1 Limitation of Liability: The Company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the property or our services. Owners and Guests agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from their actions or omissions.

7.2 Dispute Resolution: Any disputes arising from these Terms shall be resolved through mediation.

8. Termination

8.1 Termination by Owner: Owners may terminate the management agreement by providing 30 days’ notice to the Company, subject to any outstanding obligations.

8.2 Termination by Company: The Company may terminate the management agreement or guest rental agreement immediately for breach of these Terms, illegal activity, or actions that jeopardize the safety or reputation of the property or Company.

9. Miscellaneous

9.1 Amendments: The Company reserves the right to amend these Terms at any time. Notice of any changes will be provided to Owners and Guests, and continued use of our services constitutes acceptance of the amended Terms.

9.2 Governing Law: These Terms are governed by the laws of the state in which the property is located, without regard to its conflict of law principles.

9.3 Entire Agreement: These Terms, along with any additional agreements and policies referenced herein, constitute the entire agreement between the Company, Owners, and Guests and supersede all prior agreements and understandings.
